These Terms of Service ("Terms") govern your use of the Whiskr online store and your purchase of products from us. By accessing our website or placing an order, you agree to these Terms.

By using our website, browsing our products, or placing an order, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you do not agree with any part of these Terms, please do not use our website or purchase our products.

3. Products and Fulfillment

Whiskr sells pet products through a dropshipping model. This means:

Products are fulfilled via dropshipping — items ship directly from third-party warehouses (primarily CJ Dropshipping's EU warehouse and China)
We do not hold physical inventory ourselves
Orders are sent to our supplier partners who pack and ship items on our behalf
Product availability depends on supplier stock levels

We strive for accuracy in all product descriptions, specifications, and images. However, please note that colors, materials, and minor details may vary slightly from images displayed on our website due to screen settings, photography lighting, and manufacturing variations.

4. Pricing and Payment

Prices are displayed in USD (v1). Local currency may apply at checkout depending on your location and payment method. All prices are subject to change without notice, but changes will not affect orders already placed and confirmed.

Payment is required at the time of order placement. We accept major credit cards, debit cards, and other payment methods as displayed at checkout.

5. Orders and Order Acceptance

When you place an order, you make an offer to purchase products under these Terms. We reserve the right to refuse or cancel orders at our discretion, including but not limited to cases involving:

Suspected fraud or unauthorized transactions
Orders to restricted regions where we cannot ship
Pricing or product description errors
Unavailability of products
Orders that violate these Terms

If we cancel your order after payment has been processed, we will refund the full amount to your original payment method.

6. Shipping and Delivery

Shipping estimates provided at checkout are in business days and represent approximate delivery timeframes. Actual delivery times may vary based on:

Destination location
Customs processing (for international shipments)
Carrier delays
Peak periods (holidays, sales events, etc.)

Delays are possible during peak periods. We are not responsible for delays caused by customs, carriers, or circumstances beyond our control.

Risk of loss and title for products pass to you upon delivery to the carrier.

7. User Accounts

You may create an account to track orders and save preferences, or you may proceed with guest checkout. Guest checkout is allowed.

If you create an account, you must:

Be at least 18 years old
Provide accurate and complete information
Keep your password secure and confidential
Notify us immediately of any unauthorized account access

You are responsible for all activity under your account.

8. Returns and Consumer Rights

As a business operating in Poland and selling to EU customers, we comply with applicable EU consumer protection laws. Consumers within the EU have a statutory right to withdraw from online purchases within 14 days of receiving goods, subject to legal exceptions.

We provide no warranties beyond mandatory EU consumer protection rights, including the legal guarantee of conformity (2 years for tangible goods).

Product images are sourced from suppliers and used with permission for the purpose of selling those products.

You may not reproduce, distribute, modify, or create derivative works from our website content without our express written permission.

10. Limitation of Liability

To the extent permitted by Polish law and EU consumer law, Whiskr and its operators, employees, and partners shall not be liable for:

Indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Damages arising from use or inability to use our website or products
Damages exceeding the amount you paid for the product in question

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

11. Governing Law and Disputes

These Terms are governed by Polish law. Any disputes arising from these Terms or your use of our website shall be subject to the jurisdiction of Polish courts, unless consumer protection law grants you the right to bring proceedings in the courts of your local jurisdiction.

If you are an EU consumer, you also benefit from mandatory consumer protection provisions in your country of residence.

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. Changes become effective when posted on this page.
